1. Acceptance of These Terms

These Terms of Use ("Terms") are a binding legal agreement between you ("you," "User") and Timothy Schofield ("we," "us," "our") governing your access to and use of the mobile application "2nd Line App" (the "App") and any related services (together, the "Services"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the App.

2. Description of the Service

The App allows you to obtain a virtual (second) phone number and use it to make and receive calls, and to send and receive text messages (SMS/MMS), subject to the limits, fees, and rules described in these Terms. The Services rely on third-party telecommunications infrastructure; availability, call quality, and number availability may vary by region and are not guaranteed.

3. Eligibility

The App is intended solely for use by individuals who are at least 18 years old. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. See our Privacy Policy, Section 12 for our children's privacy commitments.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs through your account. You must provide accurate information when creating your account and notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your account.

5. Fees, Subscriptions, and Refunds

Certain features of the App — including virtual phone numbers, calling credits, and subscription plans — are offered for a fee. All purchases are processed through Apple's in-app purchase system, with subscription management supported by RevenueCat, Inc. Prices, billing cycles, auto-renewal terms, and cancellation options are as disclosed at the point of purchase and are governed by the Apple Media Services Terms and Conditions. Refunds, where available, are handled by Apple in accordance with its own policies; we do not process refunds directly and cannot guarantee any specific refund outcome.

6. Acceptable Use and Your Legal Responsibility

You are solely and personally responsible for your use of the App and for all calls, messages, and other content you send, receive, or facilitate through it. The App may not be used for any unlawful, fraudulent, or abusive purpose. Violating this Section is a material breach of these Terms.

The App is designed exclusively for legitimate person-to-person (P2P) communication, including your own personal conversations and your own professional communication with clients or colleagues. Automated messaging, Application-to-Person (A2P) traffic, high-volume or mass-marketing use is strictly prohibited.

By using the App, you agree that you will not, and will not attempt to:

The complete, detailed rules governing accounts, calling practices, and messaging content — including the specific categories of prohibited content, consent requirements for messaging, and the enforcement actions that apply to violations — are set out in Section 8 of our Privacy Policy, which is incorporated into these Terms by reference and forms a binding part of your agreement with us. You must review and comply with that Section in full.

We reserve the right, at our sole discretion and without prior notice, to monitor, filter, block, or refuse to transmit any call or message, and to suspend or terminate your account, revoke your phone number(s), and forfeit any unused balance, if we reasonably believe you have violated this Section. We may also report violations to law enforcement or affected third parties.

You acknowledge that you — and not us — bear personal legal responsibility, including potential civil and criminal liability, for any unlawful use of the App, and you agree to indemnify us as set out in Section 12 below.

7. Call Recording

If the App offers a call-recording feature, you are solely responsible for determining whether recording a given call is lawful in your jurisdiction and the other party's jurisdiction, and for obtaining any consent required by applicable law before recording. Many jurisdictions require the consent of all parties to a call before it may be recorded. We disclaim all liability for your use or misuse of any recording feature.

8. Third-Party Services

The App relies on third-party providers to deliver its functionality, including telecommunications and messaging infrastructure, payment processing, analytics, and cloud hosting (see Privacy Policy, Section 5). Your use of the App is also subject to the applicable acceptable-use and service policies of these providers, including Twilio's Acceptable Use Policy. We are not responsible for outages, errors, or limitations caused by third-party providers.

9. Intellectual Property

The App, including its software, design, trademarks, and content (excluding content you submit), is owned by Timothy Schofield or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, reverse-engineer, or create derivative works from the App except as permitted by applicable law.

10. Disclaimer of Warranties

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THE AVAILABILITY OF ANY SPECIFIC PHONE NUMBER, CALL QUALITY, OR MESSAGE DELIVERY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Timothy Schofield AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING ANY UNLAWFUL USE BY YOU OR ANY THIRD PARTY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE [12 MONTHS] PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Timothy Schofield and its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms, including Section 6 (Acceptable Use); (b) your violation of any applicable law; (c) any content you send, receive, or facilitate through the App; or (d) your infringement of any third party's rights.

13. Suspension and Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or our Privacy Policy, or for any other reason at our discretion, including discontinuation of the Services. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including Sections 6 and 9–12) will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or by other reasonable means, and will indicate the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
